New York Cannabis Laws: A Plain-English Guide for Adults 21+

This page is general information for adults 21 and older about legal cannabis in New York. It is not medical or legal advice and does not claim that cannabis treats, cures or prevents any condition. Talk with a licensed healthcare provider about your health, and with an attorney about your legal situation.

New York legalized adult-use cannabis in 2021, and the rules have been amended several times since. Here are the basics, with an official source for every legal point. Pure Leaf Flower (Mirae Corp) holds New York State Office of Cannabis Management (OCM) Adult-Use Retail Dispensary License OCM-RETL-25-000458 and operates at 40-28 Murray Street, Flushing, NY 11354.

Quick facts

Topic New York rule
Minimum age 21+ with valid government-issued photo ID

Buy in one day 3 ounces of cannabis and 24 grams of concentrate; a dispensary may set lower limits

Home grow 3 mature and 3 immature plants per adult; 6 and 6 per residence

Who can buy, and what ID works

You must be 21 or older, and dispensaries cannot sell or deliver to anyone under 21. New York accepts a driver license or non-driver ID from any U.S. state or territory, D.C. or a Canadian province; a U.S. or foreign passport; a U.S. armed forces ID; or another government-issued photo ID showing your age (Source: OCM). Visitors from other states can shop with valid ID, and no medical card is needed. Dispensaries must also refuse service to anyone who appears visibly intoxicated. New here? See First-Time Visitors.

How much you can carry, buy and keep

Under the Marihuana Regulation and Taxation Act (MRTA) and Penal Law Article 222, adults 21+ may possess up to 3 ounces of cannabis and 24 grams of concentrated cannabis in public; edibles, vapes and oils count toward the concentrate figure (Source: OCM). At home, Penal Law 222.15 allows up to 5 pounds of cannabis or the equivalent weight in concentrate, which OCM calculates as roughly 640 grams, kept in a secure place that is not accessible to anyone under 21 (Source: OCM). The daily purchase limit is the same 3 ounces and 24 grams. You may give cannabis to another adult 21+ within those limits with no payment and nothing of value exchanged; selling, trading or bartering it is not legal.

Growing at home

Adult-use home cultivation became legal on June 26, 2024. Each adult 21+ may grow 3 mature and 3 immature plants, capped at 6 mature and 6 immature per private residence no matter how many adults live there. Plants must be at a private residence, in a secure spot that is not plainly visible from public view, and selling homegrown cannabis is never allowed. Local governments cannot ban home cultivation, though they may add reasonable requirements, and growers must take reasonable steps to control odor (Source: OCM). Licensed dispensaries may sell seeds and immature plants; check our menu for what is currently available.

Where you can and cannot use cannabis

Generally you may smoke or vape cannabis where tobacco smoking is allowed, such as a private home or backyard. OCM states that cannabis cannot be used in motor vehicles, businesses and restaurants including patios, federal property including public housing, or most public and state parks and beaches (Source: OCM). Penal Law 222.10 also bars it anywhere smoking or vaping is prohibited under the state Clean Indoor Air Act and on school grounds and school buses, with a civil penalty of up to $25 or up to 20 hours of community service (Source: Penal Law 222.10).

Landlords may bar smoking, vaping and growing on their property but cannot refuse to rent to someone because they consume cannabis (Source: OCM). On-site consumption is a licence type created by the Cannabis Law, but OCM's licensing page lists that application window as anticipated rather than open, so check OCM for current status. Dispensaries, including ours, cannot allow consumption on the premises (Source: OCM).

Driving, vehicles and travel

It is illegal to drive under the influence of cannabis. The charge is Driving While Ability Impaired by a Drug under Vehicle and Traffic Law 1192(4); New York has no set THC blood level defining impairment, so cases rest on observed impairment and testing. DMV lists a first offense as a $500 to $1,000 fine, up to a year in jail, and licence revocation for at least six months (Source: NY DMV). Consuming cannabis in a motor vehicle on a public highway is barred for drivers and passengers alike (Source: VTL 1227). Keep purchases sealed and out of reach, do not ride with an impaired driver, and plan a sober ride or use public transportation.

It is illegal to cross state lines with adult-use cannabis, even between two states where it is legal (Source: OCM). Cannabis also remains a controlled substance under federal law, and airport security screening is federal, so do not travel with it. Keep it in New York.

Buying legal, and verifying a dispensary

Products sold by licensed New York dispensaries are lab tested for contaminants and labeled with potency as state law requires (9 NYCRR Part 130). Products sold outside the licensed market are not tested or labeled under those rules. Two checks:

  • Every licensed dispensary must post the Dispensary Verification decal with its QR code near the main entrance (Source: OCM).
  • OCM's Buy Legal map at buylegal.cannabis.ny.gov lists licensed adult-use dispensaries statewide.

On the product, look for New York's universal symbol and the QR code or link to the Certificate of Analysis; Reading Labels explains each part. Report a concern about a product or a business at cannabis.ny.gov/report-an-incident.

Adult-use and the medical program

Pure Leaf Flower is an adult-use retail dispensary. We do not certify patients and do not dispense medical cannabis, which is sold by Registered Organizations under a separate program with different product forms, serving sizes and pricing. To learn about the New York State Medical Cannabis Program, visit cannabis.ny.gov/patients.

Taxes on your receipt

Since June 1, 2024, adult-use cannabis is taxed at 13% at retail (9% state plus 4% local), distributors pay a separate 9% tax when selling to retailers, and adult-use cannabis is exempt from ordinary sales tax; the older per-milligram potency tax was repealed (Source: NYS Tax Department). The 4% local share on a sale in Flushing goes to New York City, which did not opt out of adult-use retail (Source: OCM).

Delivery and online ordering

State rules let licensed dispensaries deliver under strict conditions: orders are prepaid with no cash at the door, ID is checked and signed for at handoff, deliveries go only to a New York residence or private business, never to a motor vehicle or a public place, and the same daily limits apply (Source: OCM). At Pure Leaf Flower, online ordering, pickup and delivery are shown as coming soon on our menu; we are not taking online orders or delivering yet. Call 646-889-4071 for current status. In-store shopping is open to adults 21+ with valid government-issued photo ID.

Work, housing and old records

Under Labor Law 201-d, employers generally may not discriminate against workers for legal cannabis use outside work hours, off premises and without employer equipment, and a positive test alone is not evidence of impairment. Employers may still ban use and possession on company property, in company vehicles and during work hours (Source: NYS DOL). Federally subsidized housing remains subject to federal law. Records for offenses repealed by the MRTA are expunged automatically by the courts, with no application needed, though federal law can still create immigration consequences.

Penalties, in brief

Penalties sit across Penal Law Article 222, the Vehicle and Traffic Law and DMV rules, and published amounts for some violations differ between sources, so we do not list figures we cannot verify. Read the statute at nysenate.gov or speak with an attorney.

New York City and Queens

Municipalities had until December 31, 2021 to opt out of retail dispensaries, on-site consumption, or both. New York City did not opt out, which is why licensed dispensaries operate in Flushing and across Queens and the other four boroughs. Per OCM's filed opt-out data, a number of towns and villages elsewhere in the state did opt out of retail dispensaries, on-site consumption, or both. No municipality may ban home cultivation. These lists change and OCM's dataset is the controlling record, so confirm a specific municipality before assuming its status (Source: OCM; opt-out data). See also Service Areas.

Store cannabis locked, out of sight and out of reach of children and pets, in its original child-resistant packaging. Start low and go slow, especially with edibles, which can take up to four hours to reach peak effects. Using cannabis and alcohol at the same time can make you more impaired than using either alone. Cannabis is not recommended for use by persons who are pregnant or nursing. New York's rules have changed several times since 2021, so always confirm current rules at cannabis.ny.gov or call OCM at 1-888-626-5151. More links: OCM Resources and the Cannabis Learning Center.

Cannabis can impair concentration and coordination. Do not operate a vehicle or machinery under the influence of cannabis.
